1. Acceptance of Terms

By accessing, browsing, registering, or using www.homefilla.com, you agree to be bound by these Terms of Use and all policies referenced herein. If you do not agree with any part of these terms, please do not use this website.

2. What Homefilla Is — and Is Not

Homefilla is an online listing and advertisement publishing platform only — NOT a real estate agency, brokerage firm, property developer, sales agent, broker, intermediary, or legal representative.
We do NOT participate in, represent, become party to, or have any involvement whatsoever in any transaction, agreement, negotiation, or dispute between users.
All listings, enquiries, communications, and agreements are directly and exclusively between the advertiser/owner and the interested party.
We do not verify, endorse, or guarantee any listing, advertisement, user, or property, and we do not handle transactions, negotiations, payments, or legal processes between parties.

3. Eligibility & User Agreement

This section forms the agreement between Homefilla (the Platform Operator) and You (the User — whether browsing, registering, listing, or advertising).

You must be at least 18 years old to create listings or accounts.
By registering, you confirm that the information you provide is accurate, current, and complete, and you are responsible for maintaining the confidentiality of your account and all activity under it.
You confirm that you are legally entitled to advertise the property, business, or services you list.
You acknowledge that all interactions are between users directly and that Homefilla bears no responsibility or liability for interactions, transactions, or outcomes between users.
You agree that Homefilla may send you service-related communications. You may opt out of non-essential communications.
Homefilla may suspend or terminate your account at any time, with or without notice, if you violate any policy or if your content is deemed harmful, illegal, or misleading.

4. Acceptable Use of This Website

You agree to use this platform only for lawful purposes and in a way that does not infringe the rights of others or restrict or inhibit anyone else's use and enjoyment of the website. Prohibited behaviour includes, but is not limited to:

Harassing, threatening, impersonating, or causing distress or inconvenience to any user.
Transmitting obscene, offensive, discriminatory, or unlawful content.
Publishing false, misleading, deceptive, or fraudulent content.
Automated scraping, bulk copying, or data harvesting without written permission.
Altering, disrupting, or introducing malicious code to any part of this website.

5. Listing Terms

Homefilla is not a broker, agent, or property representative. We provide online space to display property listings only. By publishing a listing you acknowledge that Homefilla is a passive publishing platform and accept full responsibility for your listing content and any resulting communications or transactions.

5.1 Listing Responsibilities

The person or entity publishing the listing bears full and sole responsibility for:

Truthfulness and accuracy of all details including price, location, size, condition, and availability.
Legal right to advertise the property.
Compliance with all applicable local laws, planning regulations, and disclosure requirements.
Responding promptly and honestly to inquiries from interested parties.

5.2 Prohibited Listings

Property you do not have the legal right to advertise.
Property subject to dispute, legal restriction, or third-party claim.
Listings containing false pricing, hidden fees, or misleading descriptions.
Anything illegal or in violation of applicable laws and regulations.

5.3 Duration, Removal & Updates

Listings remain published for the selected duration. You may remove your listing at any time from your account dashboard, and you agree to keep listings accurate and up to date. Homefilla may remove listings that violate these terms, are reported as false, or are flagged by users — without prior notice.

6. Advertising Terms

By purchasing or placing any advertisement on Homefilla (business profiles, banners, featured listings, or any paid promotional content), you agree to the following.

6.1 Advertiser Responsibilities

All information, images, and content in your advertisement is true, accurate, lawful, and not misleading.
You have all necessary rights, permissions, and consents to publish the content.
Your advertisement does not infringe copyright, trademark, privacy, or any other rights.
Your advertisement complies with all applicable laws and regulations of the regions you target.

6.2 Approval, Placement & No Endorsement

Homefilla reserves the right to review, approve, reject, or remove any advertisement at any time without providing a reason. Display positions are subject to platform layout and may change without notice; we do not guarantee fixed positions or specific view counts. Advertisements do not imply endorsement by Homefilla, and all transactions are between the advertiser and the visitor directly.

7. Community & Content Policy

To keep Homefilla a safe, respectful, and useful platform, all listings, advertisements, messages, and content must be truthful, legal, respectful (free from hate speech, discrimination, or harassment), appropriate (free from adult, violent, or explicit material), and non-infringing.

You are solely responsible for everything you post. Homefilla does not pre-verify every piece of content but reserves the right to remove content that violates this policy. If you encounter content that appears false, illegal, or inappropriate, please report it to support@homefilla.com with the URL and a description. Publication on Homefilla does not constitute our endorsement, verification, or agreement.

8. Refund & Cancellation Policy

Payments made to Homefilla are for digital listing and advertisement placement services. These services are digital and non-tangible — once activated they begin immediately.

Before publication: You may cancel and request a full refund. Refunds are processed within 10–15 business days to the original payment method.
After publication: No refunds are provided for the published duration. You may request removal at any time, but no portion of the fee is refunded.
Platform downtime: If the website is unavailable for more than 7 consecutive days due to our technical failure, you may request a pro-rata refund for the unavailable period. No refunds are provided for scheduled maintenance or circumstances beyond our control.
Exclusions: Refunds are not granted where you no longer require the service after publication, provided incorrect information/content, or had content removed for policy violations.

Send refund requests (with your Order ID, Email Address, and Reason) to support@homefilla.com. We respond within 5 business days.

9. Intellectual Property & Copyright

All original content, design, layout, logos, graphics, software, and platform functionality on www.homefilla.com are the exclusive property of Homefilla and protected by copyright, trademark, and other intellectual property laws. You may not reproduce, distribute, modify, or use any Homefilla-owned content without our explicit written permission.

By posting content (listings, text, images, logos), you declare that you own or have full rights to publish it, you grant Homefilla a worldwide, non-exclusive, royalty-free license to display, publish, format, and promote that content solely to operate and promote the platform, and you retain all copyright ownership. If you believe content on Homefilla infringes your copyright, notify us at info@homefilla.com with a description of the work, the infringing URL, your contact details and signature, and a good-faith statement. We will review and take appropriate action.

10. Legal Disclaimer

Homefilla IS NOT a real estate agency, brokerage firm, estate agency, business broker, or intermediary of any kind. We operate solely as an online classified advertisement and listing platform. We do NOT act as an agent in any transaction, negotiate prices or terms, verify the accuracy or legality of any listing, verify ownership or authority to sell/rent, handle payments or funds, or provide legal, financial, tax, property, or valuation advice.

All listings, descriptions, photos, documents, and details are provided solely by advertisers/owners. Homefilla accepts no liability for the content of listings, any omissions or inaccuracies, misrepresentation, intellectual property infringement, or any loss or damage arising from use of this platform. We strongly advise all users to independently verify all facts and documents, conduct full due diligence, obtain independent professional advice, and comply with all applicable laws before committing to any transaction.

11. Accuracy of Information & Third-Party Content

All listings, advertisements, and content are provided by third-party users and advertisers. Homefilla makes no representation or warranty — express or implied — regarding the accuracy, completeness, currency, legality, or reliability of any content displayed. This website may contain links to third-party sites provided for convenience only; Homefilla has no control over and assumes no responsibility for their content or practices.

12. Limitation of Liability

To the fullest extent permitted by law:

Homefilla, its owners, and staff shall have NO liability for any direct, indirect, incidental, special, consequential, or punitive damages arising out of or connected with your use of this platform.
This includes loss arising from inaccurate listings, misrepresentation, fraud, failed transactions, user conduct, data loss, or platform unavailability.
You expressly acknowledge that Homefilla is a neutral publishing platform and release us from all claims, demands, and damages arising from interactions with other users or advertisers.

13. Indemnification

You agree to indemnify, defend, and hold harmless Homefilla and its representatives from all claims, damages, losses, liabilities, costs, and expenses arising from: content you publish, your use of this platform, your transactions with third parties, or your violation of these Terms or any rights of others.

14. Modifications

We reserve the right to modify these Terms of Use, policies, or platform features at any time. Changes become effective immediately upon posting. Your continued use of the website after changes are posted constitutes your acceptance of the updated terms.

15. Governing Law

These Terms of Use shall be governed by and construed in accordance with applicable laws, without regard to conflict of law principles. Any dispute arising under these terms shall be resolved through amicable negotiation first.
